DAY CARE INSPECTIONS: Minnieland Academy at Braemar Cited for Not Maintaining Staff Background Checks

The Virginia Department of Social Services inspected the Minnieland Academy At Braemar in Bristow Feb. 26. The agency noted violations in the facility's records on staff background checks and children's emergency contact information.

The day care center, located at 12700 Correen Hills Drive, was previously cited April 1, 2013 for failing to maintain proper records of staff background checks.

Virginia Department of Social Services Comments:

An unannounced monitoring inspection was conducted today with the director. Many of the children were on their cots preparing for nap time. Ninety-seven children were present with eleven staff providing supervision. For lunch, the children were provided chicken nuggets, mac-n-cheese, kale/peas, pineapple and milk. Five staff and children's files were reviewed today and a sample size of six medications were also reviewed. Staff interviews were conducted in each classroom. Fire inspection: 12/16/13 Health inspection: 9/10/13 Arrival time: 12:20 p.m. Departure time: 3:30 p.m.

Violations

Standard #:  22VAC40-185-160-C

Description: Based on interviews and a review of a file, it was determined that the contract employee's tuberculosis test had not been renewed every two years . Evidence: The contract employee's tuberculosis test was dated 9/8/07 and it had not been renewed every two years.

Action to be Taken: An updated TB test with negative results has been added to the Child Find teacher's file.

Standard #:  22VAC40-185-60-A

Description: Based on a review of five children's files and an interview with the director, it was determined that two children had incomplete emergency contact information on file. Evidence: Child A ( enrolled on 11/27/12) was missing one emergency contact and did not have the address for the second contact. Child B ( enrolled on 12/2/13) did not have the address for either of the emergency contacts.

Action to be Taken: Complete addresses for emergency contacts have been added for both children.

Standard #:  22VAC40-185-510-C

Description: Based on an inspection of the older infant room and interviews with staff and the director as well as a review of the medication log, it was determined that medication was at the center without parental authorization. Evidence: The Licensing Inspector observed Orajel stored in Infant C's basket. Interviews revealed that the medication has been there for months. Interviews further revealed that there was no parental or physician authorization for this medication. Interviews revealed that the medication had never been given.

Action to be Taken: The Orajel was returned to the parent.

Standard #:  22VAC40-191-40-D-3-A

Description: Based on observation, interviews and a review of a file, it was determined that the contract employee did not have a sworn disclosure statement on file. Evidence: There was no sworn disclosure statement on file for the contract employee, who reported that she has been providing instruction at the center for years.

Action to be Taken: The Child Find teacher has completed a sworn disclosure statement and it has been added to her file.

Standard #: 22VAC40-191-40-D-3-D

Description: Based on observation, interviews and a review of a file, it was determined that the center and the contract employee had not renewed her criminal history record check and central registry finding every three years. Evidence: The contract employee is providing private instruction at the center to several children. The contract employee reported that her background checks were done initially through a local school system but that they had not been renewed. The Licensing Inspector observed in the contract employees file a criminal history report dated 10/12/07 and a central registry finding dated 6/23/08.

Action to be Taken: New background checks have been submitted for the Child Find teacher.

The Virginia Department of Social Services inspects all licensed child-welfare agencies at least twice a year, with at least one unannounced inspection each year.

“In order to determine continued compliance with standards during the effective dates of the license, the department’s licensing representative will make announced and unannounced inspections of the facility or agency during the hours of its operation,” the agency states on their website. “The licensee is responsible for correcting any areas of noncompliance found during renewal or monitoring inspections.”

VDSS cautions that a compliance history is in no way a rating for a facility; online compliance reports do not include consideration that some information regarding “adverse actions” may be the subject of pending appeals.

According to the agency, “through the administration of the licensing program, the Department of Social Services assumes responsibility to ensure that licensed facilities and agencies provide children and adults with at least a minimum level of care in accordance with regulations prescribed by the State Board of Social Services and Child Day-Care Council.”
