Day Care Inspections: Montessori School of Gainesville Inspected Again Dec. 19

Two months after a monitoring inspection, the licensed child day care center, Montessori School of Gainesville, located at 14421 Newbern Loop in Gainesville, received a renewal inspection by the Virginia Department of Social Services. The report noted seven violations.

Virginia Department of Social Services Comments:

A renewal study was conducted today with the Director and Owner. Seventeen children were present with two staff providing direct supervision. A sample of files were reviewed today. The center is not administering medications at this time. Arrival time: 1:35 p.m. Departure time: 4:10 p.m.

Violations

Standard #: 22VAC40-185-130-A

Description: Based on a review of eight children's files it was determined that one child did not have an immunization record upon enrollment. Evidence: Child A does not have an immunization record on file.

Action to be Taken: his child will not be allowed to return to the center until we have the physical and immunization record.

Standard #:  22VAC40-185-140-A

Description: Based on a review of eight children's files, it was determined that one child did not have a physical on file within 30 days of enrollment. Evidence: Child A (enrolled on 9/4/12) did not have a physical on file.

Action to be Taken: This child will not be allowed to return to the center until we have the physical and immunization record.

Standard #: 22VAC40-185-160-A

Description:  Based on a review of six staff files, it was determined that one staff did not have a tuberculosis test/screening on file within 21 days of hire. Evidence: Staff B (hired 6/8/12) did not have a tuberculosis test/screening on file.

Action to be Taken: This staff will get the screening/test.

Standard #: 22VAC40-185-40-E

Description:  Based on direct knowledge by the Licensing Inspector(LI), it was determined that staff A was allowed to return to the center after the center was told that this staff could not be in the building until they had obtained two of the background checks. Evidence: On 10/16/12 and 10/18/12 the LI told the center that staff A could not return to the center in any capacity until they have obtained the criminal records check and central registry finding. On 10/19/12, the LI called the center and staff A answered the phone.

Action to be Taken: I wasn't here to answer the phone but I did. Staff left the center soon thereafter and did not return until we obtained both background checks. We will make sure in the future that this does not happen again.

Standard #: 22VAC40-185-80-A

Description:  Based on observation by the LI and an interview with staff, it was determined that there was no attendance in the classroom where 14 children were present.

Action to be Taken: We will make sure to keep an attendance with the children.

Standard #: 22VAC40-185-280-B

Description:  Based on observation by the LI, it was determined that in the Primary Room, there was a container of Febreze and spray paint unlocked.

Action to be Taken: Locked during the inspection.

Standard #: 22VAC40-185-550-A

Description:  Based on observation by the LI and interview with the director and owner, it was determined that the Emergency Preparedness Plan did not address all of the required information outlined under this standard.

Action to be Taken: We are working on addressing the issues discussed and we will send our LI the completed plan.

The Virginia Department of Social Services inspects all licensed child welfare agencies at least twice a year, with at least one unannounced inspection each year.

“In order to determine continued compliance with standards during the effective dates of the license, the department’s licensing representative will make announced and unannounced inspections of the facility or agency during the hours of its operation,” the agency states on their website. “The licensee is responsible for correcting any areas of noncompliance found during renewal or monitoring inspections.”

VDSS cautions that a compliance history is in no way a rating for a facility and online compliance reports do not include consideration that some information regarding “adverse actions” may be the subject of pending appeals.

According to the agency, “Through the administration of the licensing program, the Department of Social Services assumes responsibility to ensure that licensed facilities and agencies provide children and adults with at least a minimum level of care in accordance with regulations prescribed by the State Board of Social Services and Child Day-Care Council.”
