Two Battlefield H.S. Students Charged with Posession of Tobacco After Drug Search

Prince William County Police charged two teen boys, 15 and 16 years old, with possession of tobacco following a drug search of Battlefield High School in Haymarket Dec. 5.

Initially, the police considered charging one of the suspects with possession of drug paraphernalia.

"The K-9 alerted on the student's bag, which did contain items that could have been used as drug paraphernalia; however, no illegal drugs were located and the items found were not illegal to possess," police spokesman Officer Jonathan Perok said.

Following the investigation, a second student was also charged with the same offense.

Under Virginia code 18.2-371.2,  no minor can purchase or possess any tobacco product. Violations are punishable by a civil penalty of $100 for the first violation and not to exceed $250 for subsequent violations. A court may assign up to 20 hours of community service in place of the civil violation for the first offense and up to 40 hours for each violation thereafter.
